Agreement to Terms

By accessing or using TinySupport's services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our services.

Description of Service

TinySupport provides a self-hostable support desk software solution. We offer both a hosted (cloud) version and a self-hosted version that you can run on your own infrastructure.

Account Registration

To use certain features of our services, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

Subscriptions and Payments

Hosted Service

Our hosted service is offered on a subscription basis. By subscribing, you agree to pay the applicable fees. Subscription fees are billed in advance on a monthly or annual basis depending on your selected plan.

Refunds

We offer a 30-day money-back guarantee for new subscriptions. If you are not satisfied with our service within the first 30 days, contact us for a full refund. After 30 days, subscription fees are non-refundable.

Price Changes

We reserve the right to modify our pricing. Any price changes will be communicated to you with at least 30 days' notice before taking effect on your next billing cycle.

Self-Hosted License

TinySupport's self-hosted version is provided under the following terms:

• You are granted a non-exclusive, non-transferable license to use the software
• You may modify the software for your own use
• You may not redistribute, sublicense, or sell the software or any derivative works
• You must retain all copyright and attribution notices

Acceptable Use

You agree not to use our services to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Send spam or unsolicited communications
• Distribute malware or harmful code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the integrity or performance of our services
• Collect or harvest user data without consent
• Engage in any activity that could damage our reputation or services

Intellectual Property

TinySupport and its original content, features, and functionality are owned by TinySupport and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any content you create using our services. By using our services, you grant us a limited license to host, store, and display your content as necessary to provide our services.

Data and Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Service Availability

We strive to maintain high availability of our hosted services. However, we do not guarantee uninterrupted access and may occasionally need to perform maintenance or updates that temporarily affect service availability.

Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination:

• Your right to use our services will immediately cease
• We may delete your account and associated data after a reasonable retention period
• You may request an export of your data before termination takes effect

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our services will be uninterrupted, error-free, or secure, or that any defects will be corrected.

Limitation of Liability

To the maximum extent permitted by law, TinySupport shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use our services
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from our services
• Any bugs, viruses, or other harmful code that may be transmitted through our services

Our total liability for any claims arising from your use of our services shall not exceed the amount you paid us in the twelve months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless TinySupport and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services or violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TinySupport operates, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the new Terms.
